The Class Action Lawsuit against Metformin was originally brought on behalf of Robert S. Atkins, a diabetic. Mr. Atkins had ordered a large dose of Metformin to help control his diabetes but was informed that he would experience some unpleasant side effects such as fatigue, nausea, and vomiting.

He felt that he had to go with the prescribed treatment even though it might have horrible consequences on him in the long run. Eventually, the case went to trial and several witnesses were called to testify regarding the dangers of Metformin.
